01 Agreement to these terms

These Terms & Conditions ("Terms") govern your access to and use of the HisabRakh mobile application, website and related services (together, the "Service"), operated by HisabRakh ("we", "us", "our"). By downloading, accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

02 Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) and able to form a binding contract to use the Service. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

03 Your account

• You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account.
• Notify us promptly at support@hisabrakh.com if you suspect any unauthorised use.

04 Licence to use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to download and use the App on devices you own or control, for your personal, non-commercial use. We reserve all rights not expressly granted.

05 Subscriptions, billing & refunds

HisabRakh offers a free plan and an optional paid subscription, HisabRakh Pro.

• Pricing. Pro is offered at Rs 299 / month or Rs 2,499 / year (prices may vary by region and are shown at checkout). The free plan may be supported by optional rewarded ads you choose to watch.
• Billing. Subscriptions are sold and billed through the Apple App Store or Google Play and are subject to their terms. Payment is charged to your store account at confirmation of purchase.
• Auto-renewal. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel any time in your App Store / Google Play account settings.
• Refunds. Refunds are handled by Apple or Google under their respective policies. We are generally unable to issue refunds directly.
• Changes. We may change prices or plan features prospectively; changes won't affect the period you've already paid for.

06 Acceptable use

You agree not to:

• Use the Service for any unlawful, fraudulent or harmful purpose.
• Reverse-engineer, decompile, or attempt to extract the source code of the App, except where permitted by law.
• Interfere with, disrupt or attempt to gain unauthorised access to the Service or its infrastructure.
• Upload malware, or content that is abusive, harassing, defamatory, or infringes others' rights.
• Use the Service to harass other members of a group or to send unsolicited messages.
• Resell, sublicense or commercially exploit the Service without our written permission.

07 Your content & shared groups

You retain ownership of the expenses, notes, messages and other content you create ("Your Content"). You grant us a limited licence to host, store, process and display Your Content solely to operate and improve the Service.

When you add others to a group or shared loan, the relevant entries, balances and messages become visible to those members according to the access role you set (equal, self-pay or read-only). You are responsible for the content you share and for who you invite. We are not a party to, and are not responsible for, the underlying debts, payments or agreements between you and other members.

08 Record-keeping only — not financial advice or a payment service

09 Intellectual property

The Service, including its software, design, logos, the "HisabRakh" name and the "Track · Split · Settle" mark, is owned by HisabRakh and protected by intellectual-property laws. These Terms do not grant you any right to use our branding without prior written consent.

10 Third-party services & app stores

The Service is distributed via the Apple App Store and Google Play and may integrate third-party services. Your use of those platforms is subject to their terms. Where Apple is concerned, you acknowledge that Apple has no obligation to provide support or maintenance for the App, and that Apple is a third-party beneficiary of these Terms entitled to enforce them.

11 Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that calculations and balances will be free of inaccuracies arising from the data you enter.

12 Limitation of liability

To the maximum extent permitted by law, HisabRakh and its affiliates will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or financial loss, arising from your use of (or inability to use) the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13 Termination

You may stop using the Service and delete your account at any time (see Request Account Deletion). We may suspend or terminate your access if you breach these Terms or use the Service in a way that could cause harm or legal liability. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

14 Changes to these Terms

We may update these Terms from time to time. We'll update the "Last updated" date and, for material changes, give you reasonable notice in the App or by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15 Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which HisabRakh is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have where you live. We encourage you to contact us first to resolve any dispute informally; many issues can be settled quickly by email.
